Busted! KMPH Investigates Stores That Charge Credit Card Fees
KMPH News investigated stores around Fresno that charge you a fee to pay with your credit card.
Last November, we found many stores violating the law.
Some said they just didn't care.
And we were surprised to find out the California Attorney General seemed to not really care either.
We decided to go back again to see if our story helped you with this problem.
We're proud to say in most cases it did.
Some are still charging the fees.
Two of the five convenience stores we busted in our report last November have stopped charging the illegal fees altogether.
One of those is this Johnny Quik store on Shaw and Brawley in Northwest Fresno.
Evergreen Market on Clinton and Brawley also stopped charging.
But Palm Bluffs Liquor continues to charge credit card fees.
And one employee inside wasn't too happy when we confronted him about it.
Reporter says, "A customer told us you guys are continuing to charge that merchant fee."
Clerk says, "I just work here. It's whatever the boss says."
But other stores, such as Broadway Liquor on Shaw Avenue, have established new payment rules since our story aired in November.
There, you can't use your credit card unless you spend at least $15 -- and that's legal.
There's a similar policy in place now at the Super Liquor 2 on Gettysburg and Willow. Their limit is $10 to use your credit card.
But it isn't legal to charge a fee to customers who don't spend a certain amount of money.
The Valero on First and Barstow charges 50 cents to customers who spend under $5.
According to the law, that's illegal, because they're still charging a fee to pay with credit.
If they were to tell their customers, you can't use your credit card unless you spend at least $5, that's legal.
And it's not just convenience stores that tack on the extra charge for swiping your card; apparently some donut shops do it too.
"If you pay under $5, I'm not going to pay the price deduct from my donut to pay for the credit card. Because I have to pay almost $500 a month. But this is my small business. I'm not a world wide business. So I cannot afford to pay the credit card machines," said Molly Kim, owner of Judy's Donuts at Champlain and Perrin.
It seems it's the small, locally-owned businesses that are more likely to break the merchant-fee law. Many told us they're just trying to cover the cost of offering credit card service.
A KMPH viewer who saw our report last November fought back.
"I ended up reporting a store that wasn't too far from my house," said James McGuire.
He says after he learned that the credit card fees he's been paying are illegal, he called Visa.
"They were taken aback that there were convenience stores doing this. It seems to me like it's not something that happens a lot. Like it's more localized," said McGuire.
The Fresno County District Attorney's office says it's not supposed to be happening at all.
Investigators tell me they contacted each store we featured in our last story, informing them about the law and there may be consequences for stores that continue to charge.
And they encourage people to file complaints with them.
Look what happened when Bank of America tried to charge a $5 monthly fee to customers who use their debit cards.
People were so mad, they switched banks. They let Bank of America know that they weren't going to stand for that.
Bank of America bowed to public pressure and decided not to charge the fee.
So it really is up to consumers, as a whole, to speak up.
